1. What is the difference between physical custody and legal custody in North Carolina?

In North Carolina, physical custody refers to where the child lives, while legal custody refers to the authority to make major decisions for the child, including medical, educational, and religious decisions. That distinction matters because some parents assume custody is only about parenting time, when it can also affect decision-making authority in a major way.

2. How do courts decide child custody in North Carolina?

North Carolina courts decide custody based on what will best promote the interest and welfare of the child. The court looks at the facts of the case and may also consider issues such as domestic violence and the safety of the child or either parent. Custody decisions are not supposed to be based on assumptions or stereotypes, which is why the way the case is presented matters. 

3. Can one parent ask for joint custody in North Carolina?

Yes. North Carolina courts recognize the importance of children having both parents involved in their lives on a regular basis, and the court will consider joint custody if either parent requests it.
